The ministers of the Federal Supreme Court (STF) began to judge, in the early hours of this Friday (9), the action that asks to swear in the substitute of the impeached deputy Deltan Dallagnol (Podemos-PR), the economist Luiz Carlos Hauly, in the Chamber of Deputies . Alexandre de Moraes and Dias Toffoli have already voted in favour.

The virtual plenary session was extraordinarily convened and ends at 11:59 pm, in which ministers only cast votes without debate. Toffoli’s vote confirmed the injunction issued by him on Wednesday (7), in which he decided on the immediate diplomation of the substitute, contrary to the position of the Regional Electoral Court of Paraná (TRE-PR), which would have pointed out in the recount of the votes the diplomation of the pastor Itamar Paim (PL) because of the party’s electoral coefficient.

For Toffoli, the 10% minimum rule does not apply to substitutes, the same position as Moraes in the decision, who said that “the vacancy won by the association must be filled by the substitute with the most votes under the same caption, regardless of the minimum nominal vote, in this case, Luiz Carlos Jorge Hauly”.

Hauly has a long career in politics in Paraná: he was a federal deputy between 1991 and 2019, state finance secretary, councilor and mayor of the municipality of Cambé, about 400 kilometers from Curitiba, in addition to being an economist and one of the main supporters of tax reform.
