STF judges salary reduction of teachers in AM in February

Manaus (AM) – The Federal Supreme Court (STF) will define between the 10th and 17th of February whether it will reduce the salary of public school teachers in Amazonas exempted, by State Law No. Mercosur countries and Portugal.

The judgment stems from the appeal filed by the Legislative Assembly of Amazonas (Aleam), after the STF determined the norm as unconstitutional, in September 2021. State Law No. in Mercosur countries and Portugal.

The Supreme considered the law unconstitutional, for not following national norms, which do not exempt the revalidation of postgraduate diplomas obtained abroad. The revalidation, at the national level, is a necessary process for the validation of the graduation diploma in Brazil.

With the appeal filed by Aleam to ensure that the salaries of promoted teachers are not reduced, the STF will judge, virtually, between February 10th and 17th, 2023, the future of teachers’ salaries without revalidation of the diploma extracted in the countries belonging to Mercosur and Portugal.

If the law is annulled by the Supreme, teachers will need to follow national norms and start the process of revalidating the diploma. In this scenario, the president of Sinteam, Ana Cristina Rodrigues, told Em Tempo that an alternative would be for the government to carry out a test similar to the Revalida of the State University of Amazonas (UEA).

“The solution would be for the State to take a test along the lines of Revalida at the UEA, as it has for medicine, and revalidate the master’s and doctoral degrees of these workers”,

said the president of Sinteam, Ana Cristina Rodrigues

Unconstitutionality

In 2021, the judgment of the STF, which declared the unconstitutionality of the state law of Amazonas, took place between August 27th and September 3rd. The STF ended the judgment with the sentence: “It is unconstitutional state law that provides for the acceptance of diplomas issued by foreign universities”.

A year earlier, in November 2020, the law was contested by the Attorney General’s Office (PGR), through a Direct Action of Unconstitutionality (ADI) No. 6592, and filed with the STF. The attorney general, Augusto Aras, said that the state norm violates the competence of the Union, which holds the authority to determine educational guidelines and edit general teaching norms.
