The National Consumer Secretary at the Ministry of Justice, Wadih Damous, says that the fact that Americanas are in judicial recovery cannot be used as a justification for the deliveries of purchases made to be delayed or canceled without reimbursement.
“Judicial recovery is not a valid argument to harm the consumer”, says Damous. The most that could happen, he says, is some kind of negotiation to extend the term.
“Evidently we are not going to disturb any negotiation. But for that we want to know from the company what mechanism it will announce to carry out this renegotiation”, he said to the Panel.
Last Tuesday (17th), the National Consumer Secretariat (Senacon) notified Americanas to inform what measures it intends to take to protect the interests of consumers, what is the impact of inconsistencies in the balance sheet for the general public and the channels for dispute resolution. The company has five days to respond.
According to Damous, the crisis that the retailer is going through, after the revelation of an accounting hole of R$ 20 billion, cannot only have an economic dimension, but also be thought of from the point of view of consumers.
He says that Senacon’s recommendation is for consumers to be cautious when making new purchases in Americanas. “Our orientation is that you place orders by phone, record the call, take prints of the screens, try to document the acquisition as much as possible”.
