In a trial that ended at 11:59 pm this Friday (9), the Federal Supreme Court (STF) decided that Luiz Carlos Hauly (Podemos-PR) will be qualified to take over the vacancy that belonged to Deputy Deltan Dallagnol (Podemos-PR), who had his term in the Chamber was annulled by the Superior Electoral Court (TSE) on May 16.

The decision overturns the understanding of the Regional Electoral Court of Paraná (TRE-PR), which had determined that Pastor Itamar Paim (PL-PR) would be Dallagnol’s alternate. Most of the STF ministers followed the vote of Minister Dias Toffoli, who responded to an appeal by Podemos and determined that Hauly take over the vacancy.

The ministers Alexandre de Moraes, Gilmar Mendes, André Mendonça, Cármen Lúcia, André Mendonça and Luis Roberto Barroso voted with Toffoli. Edson Fachin, who opened a divergence, was accompanied by Luiz Fux and by the President of the STF, Minister Rosa Weber. The vote score was 6 to 3.

Itamar Paim, who lost his seat after the STF decision, had added 47,000 votes at the polls last year. Hauly, on the other hand, received just over 11,000 votes. Now 72 years old, the man from Paraná held the position of federal deputy for seven consecutive terms, from 1991 to 2019.
