In an action signed by the deputy prosecutor Arthur Senra Jacob, the Public Ministry of Amapá (MP-AP) filed a complaint against a group of people linked to the company DEV Mineração, accused of embarrassing, with the use of violence, Sebastião dos Santos Cardoso, causing intense physical suffering in order to obtain information, resulting in incapacity for usual occupations, for more than thirty days.
The accused are Antônio Fernandes da Costa Neto, Benedito de Oliveira, Raquel Diniz Dal Seco, Marcley da Silva Borges, Ivan Eustáquio de Miranda, Gilvan Ferreira de Souza, Josinaldo Paixão da Silva, Jobson Silva de Oliveira and Ronaldo César Pereira Martins. The action is being processed by the Criminal Court of the Jury Court of the District of Santana.
According to the complaint, on September 27, 2021, inside the company DEV Mineração S/A, on Avenida Santana, the accused tortured Sebastião dos Santos Cardoso, who at the time of the facts, as a re-educator, services for DEV Mineração SA, as stated in the contract entered into between the Community Council on Criminal Execution and the company.
According to what was found, after the theft of a purse and a notebook, both belonging to Raquel Diniz Dalseco, Sebastião was identified as a suspect in the crime. He was called by Jobson Silva de Oliveira, known as Papagaio, and Josinaldo Paixão da Silva, known as Barata, and taken to the train carriages (the furthest zone from the mining company) where physical attacks began, which turned into beatings.
The violence consisted of the denounced throwing punches to the head and chest, hanging with a rope, kicking the body, blows with a piece of wood hitting the head, arm, face and burns. As stated in the witness statements, the scene was filmed.
“It should be noted that at a certain point the accused Raquel Diniz poured two bottles of alcohol on the victim saying: “YOU WILL DIE AÍ! I’M GOING TO SET YOU ON FIRE AND BURY YOU IN THIS HOLE!” Furthermore, the intention of the torture was to extract a confession from the victim in view of the alleged authorship of the theft”, wrote the prosecutor in an excerpt from the complaint.
Forensic examinations found a series of injuries on Sebastião’s body, including a blunt injury in the anterior cervical region caused by mechanical asphyxiation with a rope-type instrument, and a blunt injury in the oral region, represented by a blunt wound sutured with three stitches in the upper lip, as well as in its internal mucosa.
The defendants’ motivation for aggression consisted of recovering Raquel Diniz’s assets that had supposedly been subtracted by Sebastião, and the promise that the reeducated project would be extinguished if the objects were not found.
In their interrogations, Raquel Diniz (from Minas Gerais and director of the company) and Ronaldo César Martins denied the facts imputed against them. Jobson Oliveira, Josinaldo Paixão, Gilvan Ferreira and Marcley Borges confessed to their participation in the attacks against Sebastião dos Santos. The accused are accused of the crime of torture.
The Public Ministry is requesting the receipt of the complaint and the adoption of the summary procedure for the criminal investigation, pursuant to article 394, paragraph 2 of the Code of Criminal Procedure, in addition to the subpoena of eight witnesses listed in the process. DEV Mineração is in the process of judicial recovery.
