STF changes understanding and rejects complaint against Renan Calheiros

The Second Panel of the Federal Supreme Court (STF) changed its understanding and, by a majority formed in a virtual plenary session on Friday (31), rejected a complaint by the Attorney General’s Office (PGR) against Senator Renan Calheiros (MDB-AL) for alleged passive corruption and money laundering in contracts of Transpetro, a subsidiary of Petrobras.
The accusation against Calheiros had been accepted by the same collegiate in 2019, but the change in the composition of the Second Panel made it possible for the parliamentarian’s defense to challenge it. The rapporteur, Minister Gilmar Mendes, was favorable and said that there was an “omission” in the previous trial, which partially accepted the complaint.
The complaint filed by the PGR accused Calheiros based on a plea bargain made by the former president of Transpetro, Sérgio Machado. Gilmar Mendes understood that the STF was omitted by not expressing which evidence of the prosecution was not based only on the accusation of the whistleblower.
In the last trial, Calheiros became a defendant by favorable votes by Celso de Mello, currently retired, Carmen Lúcia, who is no longer part of the Second Panel, and by Fachin. The appeal approved on Friday had the favorable votes of Gilmar, Ricardo Lewandowski and Nunes Marques. Fachin and André Mendonça rejected.
On his Twitter profile, Calheiros celebrated the decision. “The STF filed yet another false complaint against me. Of the 39, 30 have already gone to waste due to lack of evidence. In another three, the PF has already recommended the filing and is awaiting the manifestation of the sleepy PGR. Reacting to Lava Jato’s lies was suffered, inhuman, but today I am not a defendant in any lawsuit”, he commented.
