SP court rejects opposition injunctions against privatization of Sabesp – 11/10/2023 – Panel

The São Paulo Court rejected this Friday (10) two requests for injunctions from opposition deputies against the Sabesp privatization bill from the Tarcísio de Freitas government (Republicanos-SP). The decisions were made by judge Matheus Fontes, rapporteur of the case at the São Paulo Court of Justice.
The requests were presented by deputies Jorge do Carmo (PT) and Guilherme Cortez (PSOL). The PT member asked for the urgent regime to be removed from the project’s processing, and the Psolista argued that the privatization process in the form of a bill is unconstitutional, as it should be through a proposed constitutional amendment, and asked for the inclusion of public administration and environmental committees in the discussion of the text in the Legislative Assembly of São Paulo.
In both cases, the judge assessed that Alesp’s regulatory issues should not suffer judicial interference. Regarding the supposed unconstitutionality of the procedure in the form of a bill, the judge stated that it is an issue that can be assessed later by the Court, after possible approval and sanction of the bill.
The bill has been discussed at the Alesp committee congress since Tuesday (7), a maneuver to speed up its processing, as shown by the Panel. The public hearing on the topic is scheduled for Thursday (16).
