Manaus (AM) — The Federal Regional Court of the 1st Region (TRF1) revoked, on Friday (12), the preventive detention of the mayor of Borba, Simão Peixoto (MDB), who was arrested by the Federal Police last Tuesday (9), during Operation Voice of Power. The decision was handed down by federal judge Solange Salgado da Silva.
The judge requested, as a matter of urgency, the release permit. With the decision, Mayor Simão Peixoto will immediately return to his role in public service. The absence from the exercise was limited to a period of 180 days.
The decision pointed out that the necessary requirements were not met and “no concrete reason was given” for the arrest and removal of the mayor. In addition to highlighting that the procedure carried out by the Federal Police only privileged the testimony of one of the witnesses, who differed from the other seven people interviewed.
“It appears that there was an unacceptable mistake regarding the application of criminal procedural rules, especially in the use of shallow and superficial presumptions as sufficient evidence to enact measures as serious as the curtailment of freedom and the removal of the holder of an elected position from their functions” ,
said in an excerpt of the decision.
Operação Voz do Politics requested the arrest of Simão Peixoto after obtaining evidence that he held video conferences with civil servants subpoenaed by the PF, offering assistance in an attempt to influence witnesses. The investigation investigates the diversion of public resources, intended for the purchase of school meals, during the COVID-19 pandemic, in 2020.
