Minister Alexandre de Moraes, of the Federal Supreme Court (STF), sent this Friday, 27, for analysis by the Attorney General’s Office (PGR) a request from lawyers for the court to suspend the inauguration and investigate possible actions of deputies Bolsonarists in the coup acts of January 8.
The minister gave a period of 24 hours for the PGR to present a statement on the case. The inauguration of the deputies is scheduled for next Wednesday (1st).
The list of deputies prepared by the group of lawyers includes Sílvia Waiãpi (PL-AP), as suspected of having participated in the violent events of January 8 in Brasília. The graduated deputy alleges that she was not in the federal capital, but posted on the social network an audio demonstration of a parliamentarian present at the demonstration.
The lawyers who made the request belong to Grupo Prerogativas, which cited actions by:

- Marcos Pollon (PL-MS)
- Rodolfo Nogueira (PL-MS)
- Joao Henrique Catan (PL-MS)
- Rafael Tavares (PRTB-MS)
- Carlos Jordy (PL-RJ)
- Silvia Waiãpi (PL-AP)
- André Fernandes (PL-CE)
- Nikolas Ferreira (PL-MG)
- Sergeant Rodrigues (PL-MG)
- Walber Virgolino (PL-PB)
The referral of this type of request to the PGR is customary and provided for in the internal rules of the Court.
This is because, according to the Constitution, it is up to the Federal Public Ministry to assess whether it proposes investigations and complaints in the criminal area and actions in the electoral area if it detects evidence of irregularities.
‘Acts against democracy’
The group of lawyers asked the STF:
- the suspension of the effects of diplomacy of parliamentarians, to prevent the inauguration
- the initiation of a police inquiry against the group, “to determine the criminal responsibility” of the deputies “in relation to the criminal acts committed on January 8”
The lawyers also requested that the Electoral Public Ministry be communicated to analyze the possibility of a lawsuit against the deputies in the Electoral Justice, for “participation or support and dissemination of coup and terrorist acts”.
For the group of lawyers, the deputies may have committed “criminal acts contrary to the democratic rule of law”. (National G1 Source)
