Silas Malafaia defends project that prohibits polyaffective unions in the Chamber

The Social Security, Social Assistance, Childhood, Adolescence and Family Committee of the Chamber of Deputies debated this Wednesday (8) Bill 4302/16, which intends to prohibit the registration of polyaffective unions, that is, a relationship with more than two people.

The debate was attended by pastor Silas Malafaia, who defended the proposal to avoid a “mess in the legal system”, in the face of records in registry offices that try to favor polyamory or threesomes, as this type of union has also been called.

In 2018, the National Council of Justice (CNJ) ordered the suspension of all registrations of polyamorous unions and prohibited registry offices from drawing up public deeds to register this type of union.

“There is no legal provision for succession or social security rights for this type of succession. The judiciary cannot have the power to establish norms that are not their responsibility, but the legislature’s responsibility”, said the pastor.

Malafaia also reinforced that “poly-affective unions” are already prohibited by the Federal Constitution. In its article 226, paragraph 3, the Magna Carta already defines monogamy as the only valid legal union in Brazil. The paragraph in question states: “For the purposes of State protection, the stable union between a man and a woman is recognized as a family entity, and the law must facilitate its conversion into marriage”.

At the hearing, Malafaia criticized the idea, presented by government supporters, of wanting to defend a “minority” that identifies with “polyamory”.

“They want to approve everything they claim is reality or protects a minority. Zoophilia is reality, are we going to approve it? So, this story that everything is reality we have to approve, soon, they will approve pedophilia, which is a minority practice, and it exists”, highlighted the pastor.

The proposal, which is being analyzed by the committee, received a favorable opinion from the rapporteur, deputy Filipe Martins (PL-TO), and may be voted on next week by the committee, as informed by the president of the committee, deputy Fernando Rodolfo (PL-PE) .
