Just as happened with the trader Cleriston Pereira da Cunha — who spent more than 10 months in the Papuda Penitentiary Complex facing serious health problems —, other prisoners for the acts of January 8 and in the Federal Police (PF) Lesa Pátria operation also have comorbidities such as heart disease, pre-diabetes, suspected cancer, toxoplasmosis, perforated eardrum and even the use of a urinary catheter.

According to information from the State Secretariat for Penitentiary Administration of the Federal District (Seape), 44 men are still in prison since January 8, and six of them are over 50 years old. A woman also remains incarcerated in the Federal District Women’s Penitentiary, and dozens of people were detained in the following months. A People’s Gazette requested information regarding their health situation, but received no response.

A report issued last week by the Public Defender’s Office of the Federal District, however, presented situations of serious comorbidities involving prisoners from 8/1. In one of the quotes presented, a 49-year-old prisoner years old says that he has a narrowed ureter and needs to use a catheter to urinate.

“The probe is given to him, and he himself passes through, with a lot of physical suffering”, describes the report, while also mentioning that the man has had infections and needs follow-up with a urologist and medication. He has four children, and the youngest is 12 years old.

Another case published by the Public Defender’s Office is that of an elderly man who has worked as a doctor for 35 years and has hypothyroidism, cardiac arrhythmia, chronic collateral fibrillation, pre-diabetes and dyslipidemia (high levels of fat in the blood). The agency did not disclose the name of the prisoner, but family members and lawyers consulted by the report confirmed that he was the general practitioner Frederico Rosário Fusco de Oliveira, aged 60.

According to lawyer Carolina Siebra, Frederico was arrested on January 8, after helping a person who was feeling ill on the outskirts of Palácio do Planalto and being invited by the police to take shelter inside the building. “The police asked him to enter because the environment was inhospitable due to the stun bombs”, reported the lawyer, informing that the doctor was arrested moments later and has been in Papuda for almost 11 months. “He has already lost 15 kg and his illnesses are getting worse”, she warns.

Documents sent by the defense to Minister Alexandre de Moraes with medical reports and prescriptions indicate that Frederico “has a serious heart disease with a history of arrhythmia”, which can “trigger cardiac arrest and embolic stroke”. The elderly man, born in Rio de Janeiro, still suffers from anxiety and insomnia attacks, and his health situation was presented to the “reporting minister at least ten times”.

“He is at risk of death due to comorbidities and we have done everything to get the prison revoked”, informs the lawyer, commenting that “minister Alexandre de Moraes’ office is the only one that does not receive the defense team, contrary to the which provides for Article 7 of the Law Statute”, explains Carolina.

In fact, she informs that she received last Wednesday (23) a favorable opinion from the Attorney General’s Office (PGR) recommending provisional freedom for the doctor — the same document obtained by businessman Cleriston Pereira da Cunha in August, almost three months before his death. death.

In addition to Frederico’s case, the Public Defender’s Office mentions that a prisoner from 8/1 is suspected of having liver cancer. There is still another with toxoplasmosis who claims he does not receive medication for the disease, and there are prisoners from January 8 with problems such as a herniated disc, narrowing of almost 70% in the cervical spine and severe mental suffering.

63-year-old prisoner with eight pins in his spine and severe depression

According to lawyer Shanisys Martins, farmer Jorginho Cardoso de Azevedo, 63, is among them. Born in São Miguel do Iguaçu, in Paraná, the elderly man has always worked on the farm, lives with his wife, and takes care of his 90-year-old father. According to the location shown on his cell phone, he arrived in Brasília in the late afternoon of January 8 and went to Praça dos Três Poderes shortly before 7 pm, when he was arrested with the other protesters at the scene.

“He did not participate in the camp or in the alleged invasion of the headquarters of the Three Powers”, points out the lawyer, mentioning that the man is also accused of “financing the acts” because the bus in which he traveled was rented in his name. “People shared all the expenses, and he passed them on to the bus company”, explains the lawyer, mentioning that the elderly man has been in prison for almost 11 months, has serious health problems and needs urgent psychological and psychiatric support.

According to medical reports sent by the defense to the STF, Jorginho has several comorbidities in his spine, including eight metal pins due to a serious injury. “His health status is critical and he must undergo continuous medical treatment”, informs the document, which cites the risk of paraplegia without adequate care.

Furthermore, the lawyer mentions that the severe pain and the environment to which the man is exposed without having committed any crime harmed his mental health. “Seu Jorginho has severe depression and frequent panic attacks,” reported another member of the defense team, lawyer Gislaine Alves Yamashita. Unfortunately, “he tried on her life all weekend,” she confided to People’s Gazette this Monday (27).

According to her, the situation worsened after the death of Cleriston, who was the farmer’s cellmate and spoke to him minutes before he died. “Seu Jorginho was upset and, in our last meeting, he started banging his head on the glass and kicking it asking, for the love of God, that we get him out of there”, he added. “The situation is extremely delicate.”

Prisoners of Operation Lesa Pátria also have comorbidities

Like him, electrical engineer Renam da Silva Sena, aged 60, also has back problems and depression. “He feels a lot of pain and can’t sleep because he used specific objects to lie down on before being arrested”, reports lawyer Rannie Karlla Ramos, who filed a new request for provisional release last week so that the elderly man can receive treatment at home, in the city of Brasília. .

“I’ve already requested specialized care for him, but it’s no use,” reveals the lawyer, who has seen the Goiano’s health worsen over the last week. “He is in pain, sees figures and has intense mental blocks”, he states, mentioning that the man was arrested in Operation Lesa Pátria on January 20th for having recorded videos asking for food donations for the camp in front of the General Headquarters of Brasilia. “He wasn’t even there.”

Another person arrested during the PF operation was journalist and municipal guard Joelson Sebastião Freitas, aged 47, who has remained in prison since March 17. According to his lawyers, the resident of Foz do Iguaçu, in Paraná, “suffers from hypertension, has a hernia and has a perforated eardrum, experiencing severe ear pain”.

“And he has definitive custody of his two-year-old granddaughter, who depends on him, so he obtained a favorable opinion from the PGR for her freedom in June, but it was denied by Moraes”, informs lawyer Tatiana Zennim, mentioning that a second opinion was issued by the Attorney General’s Office in September, but was also rejected.

According to the defense, Joelson acted as a reporter during the demonstrations on January 8 and took a video on the Planalto ramp showing that there was blood on the ground. “These images were linked by a broadcaster and, therefore, he has been imprisoned for more than 250 days”, says the lawyer, informing that the man is around 700 kilometers from home — in the Penal Medical Complex (CMP), in Curitiba — and, as he had nowhere else to turn, he began a hunger strike this Monday (27).

“He will not even continue with his controlled daily medication, as part of the self-imposed protest”, reports his wife, Marisa Aparecida Aires Nogueira, stating that the action is also for Cleriston and the other prisoners from January 8th. “Joelson calls on Mr. Alexandre de Moraes for this pardon for himself and his peers imprisoned in Brazil”, he concludes in an open letter sent to People’s Gazette.
