Senator presents PEC to make all collection of union dues optional

Senator Cleitinho (Republicanos-MG) filed this Tuesday (19), with the support of over 30 colleagues, a Proposed Amendment to the Constitution (PEC) to make all collection of union contributions from workers optional. In order for the PEC to be processed, it needs at least 27 signatures.
Its proposal is a reaction to the recent decision of the Federal Supreme Court (STF) to consider possible the compulsory collection of contributions from non-union members, putting an end to union freedom.
In his justification for PEC 46/2023, the senator recalled that the labor reform approved in 2017 had already eliminated the compulsory payment of union contributions, as a way of valuing the freedom of association provided for in the Constitution.
Furthermore, he recalls that only 11.2% of workers are formally represented by trade unions. “Unions currently lack representation. It is only fair that workers and employers who are not affiliated with their respective unions are not forced to contribute to entities that do not represent their interests,” he explained.
