Senator Kajuru articulates PEC that will prohibit active military personnel from becoming ministers

Senator Jorge Kajuru (PSB-GO) is the rapporteur of the Proposed Amendment to the Constitution (PEC) that makes it mandatory for members of the Armed Forces to be transferred to the reserve if they want to contest elections. Kajuru’s replacement, however, should also prevent active military personnel from being appointed to ministries. “A bomb in my hand to decide my vote”, defined the senator himself on his profile on the social network X (formerly Twitter).

The proposal is being processed by the Constitution and Justice Committee and could be discussed next week. According to the newspaper Estado de S. Paulo, Kajuru will speak with the Minister of Defense, José Mucio Monteiro, before finalizing the report. The idea is to vote on the text by the second week of November at the latest.

“It’s going to be a controversial debate, but I have support from the majority,” said the senator on his social network X (formerly Twitter).

The author of the proposal is PT senator Jaques Wagner (PT-BA). The original text did not include a restriction on participation at the highest level of government because it considered the measure “discriminatory”. However, the point ended up being included in the proposal because the government argues that the rules for participation in the electoral process affect the prerogatives of the military, but the restriction on appointments to ministries involves an attribution from the president. Under current rules, military personnel only need to withdraw from activities if they are elected.
