Ministry of Human Resources should request exclusion of prisons from PPPs – 10/15/2023 – Panel

The Ministry of Human Rights is considering proposing the exclusion of prisons from the list of sectors that can be managed in partnership with the private sector (PPPs).

To do this, a decree from April this year would need to be amended, which added a series of segments in which companies would receive tax benefits for signing PPPs. The prison system was one of the sectors included.

The change has been studied after movements, entities and experts linked to the topic argued with the government that this sector cannot be “privatized”.

There are currently two PPP projects being implemented, in the states of Rio Grande do Sul and Santa Catarina.

According to this model, initiated by the Jair Bolsonaro (PL) administration and which has financing from the BNDES, private companies take care of the construction and administration of the physical facilities of the prisons, while the state maintains responsibility for the management and security of inmates.

Minister Sílvio Almeida ordered a technical note on the topic for the coming weeks.

According to department technicians, the tendency is for the device to be revoked or the decree changed so that the incentive for privatization can be blocked. One of the technicians states that “the overwhelming majority of prison privatization experiences have been disastrous.”

Another argument is that most states do not have a technical structure for adequate contract management, which opens the way for human rights violations.
