The Senate Public Security Commission approved this Wednesday (12) the bill by Senator Sergio Moro (União Brasil-PR) that provides for 4 to 12 years in prison for anyone who plans to attack or threaten authorities who fight crime. organized.

The PL (bill) also extends personal protection to retired police, magistrates and public prosecutors who are under threat of crime. Today, the legislation provides for security measures only for authorities who are on active duty and family members.

Moro presented the project after the PF (Federal Police) launched an operation last month to dismantle a plan by the PCC criminal faction against him and other authorities, such as prosecutor Lincoln Gakiya, who is investigating the group.

According to Gakiya, who coordinates the main group of the Public Ministry against organized crime, Moro would be in the sights of the PCC for having prevented intimate visits in federal prisons when he was Minister of Justice and Public Security of Jair Bolsonaro (PL).

Rapporteur of the matter, Senator Efraim Filho (União Brasil-PB) stated in his opinion that the plan against Moro —reprimanded by the PF— and the attacks by factions in Rio Grande do Norte reveal that “the audacity of the criminals exceeded all limits” , which calls for a “severe response” against organized crime.

Senator Omar Aziz (PSD-AM) even asked for more time to analyze the project, but went back and said he would do it in the next commission. Without naming names, Aziz criticized the media attitude of judges and prosecutors, and said that it is necessary to understand who will pay the protection bill to the authorities.

“Who is going to pay for this? The good citizen who is being threatened and who has no protection. You get a police officer, either from the Federal Police or the Civil Police, from the Military Police to provide security when these judges leave…”, said Aziz, without finishing the sentence.

“The truth is that, these judges, we shouldn’t even know their names. But people want to go to the media. little I will have to give protection to the police because he arrested the drug dealer”, he added.

“Our Brazilian legislation has this flaw of not curbing and punishing the planning of an attempt against the life of a senator, a judge, a magistrate. [Plano] proven. If there is video, photo, print, clip, [mas] if the guy didn’t shoot at you, there’s no punishment”, argued Efraim.

The bill was approved on a symbolic basis —without counting the votes— and goes to the Senate’s CCJ (Constitution and Justice Commission). In the text of the bill, Moro mentions that two federal penitentiary police officers and a psychologist have been murdered by the PCC since 2016.

“It is verified that there are no types in material criminal law that reproach, with the necessary severity, preparatory acts for the practice of serious attacks against public agents, such as police officers, judges or prosecutors. Murders of prison police officers […] can only be punished if consummated or attempted”, justifies Moro in the PL.

“Hypothetically, if the police discover a plan by a criminal group to assassinate a judge, they would, in principle, have to wait for the start of the execution of the crime before interfering so that the fact is configured as criminally relevant, which places the agent public at grave risk.”

The Senate Public Security Commission also approved the appointment of the Minister of Justice and Public Security, Flávio Dino (PSB). The minister’s departure is scheduled for May 2.
