Rosa Weber leaves STF and opens new vacancy for Lula’s nomination

Minister Rosa Weber presided, this Wednesday (27), the last session in command of the Federal Supreme Court (STF). Appointed by former president Dilma Rousseff in 2011, Rosa will leave the court in the next few days upon turning 75 and compulsorily retiring.

In her farewell speech, the minister highlighted the coup acts of January 8th. She recalled that, for the first time in history, the Court’s headquarters was invaded and vandalized. Rosa stated that the episode showed that “democracy was unshaken”.

“Our democracy remains unshakable, as it remains unshakable, symbolized in this fully restored plenary. The warning remains: it is up to everyone to uncompromisingly defend constitutional democracy”,

he stated.

Rosa Weber also said that she had the opportunity to get to know the country by visiting prisons, quilombos and indigenous lands.

“Based on the work developed, we will get to know more and better this Brazil with so many Brazils, this plural Brazil, with so many inequalities and ills and, at the same time, with so many beauties and riches of all kinds”,

concluded.

Tomorrow (28), replacing Rosa Weber, minister Luís Roberto Barroso will take office as president of the Court.

Trajectory

Rosa took office in December 2011. She filled the vacancy left by the retirement of Minister Ellen Gracie, the first woman to be appointed to the Court, in 2000.

Weber was nominated by former president Dilma Rousseff. Before arriving at the Supreme Court, the minister had a career in the Labor Court, where she started as a labor judge in Rio Grande do Sul and reached the position of minister of the Superior Labor Court (TST).

During her time at the Court, the minister stood out for her vote in favor of the decriminalization of abortion up to the 12th week of pregnancy and the demonstration against preventive habeas corpus to avoid the arrest of President Luiz Inácio Lula da Silva, in 2018.

This week, in her role as president of the National Council of Justice (CNJ), Rosa managed to articulate the approval of the resolution to expand the promotion of women in the judiciary.

At the CNJ, the minister also resumed carrying out prison efforts and visited indigenous territories, in addition to launching the first Constitution in indigenous languages.

Open position

The vacancy left by Rosa Weber must be filled by appointment by President Luiz Inácio Lula da Silva. There is no deadline for appointment.

After defining the name, the nominee will need to be approved by the Constitution and Justice Committee (CCJ) of the Senate and by the plenary of the House. Possession will then be scheduled.

With Rosa’s departure, the Court’s plenary will be composed, albeit temporarily, of just one woman, Minister Cármen Lúcia. The scenario may change depending on Lula’s nomination.
