Dorinaldo’s project forces digital platforms to remove fake news that causes harm to health within 12 hours – News of Brazil

Bill 1809/23 obliges internet providers to remove false or misleading content with the potential to cause harm to the health of the population within 12 hours. The deadline begins after the person responsible is notified by the competent health authority, be it municipal, district, state or federal.

Author of the proposal, deputy Dorinaldo Malafaia (PDT-AP) states that “scientific denialism, the anti-vaccine movement and charlatanism have found social networks and digital platforms a fertile space for their dissemination”.

In his assessment, the low regulation of the sector, while allowing the exercise of creativity and freedom of expression, has the “harmful consequence” of being slow to respond to unfounded rumors circulating on the networks.

“If the health authorities point out what this content is, the platforms will be able to act in time to prevent these rumors from causing harm to public health”, says Malafaia. “At the same time, these same platforms will be sure that they are contributing to a healthy virtual space free from lies”, adds the parliamentarian.

Under analysis in the Chamber of Deputies, the text also includes guidelines to combat the dissemination of fake news about health in the Unified Health System Law (Law 8,080/90) and in the Marco Civil da Internet (Law 12,965/14).

Digital literacy

Furthermore, according to the project, public initiatives to promote digital culture and promote the internet as a social tool should encourage digital literacy. The intention is to minimize the impact of the circulation of rumors, fake news and lies that put the health of the population at risk.

Processing

The proposal will be conclusively analyzed by the Science, Technology and Innovation committees; of communication; and Constitution and Justice and Citizenship.
