Rosa Weber accepts request to judge the next 8/1 defendant in the virtual plenary

The president of the Federal Supreme Court (STF), Minister Rosa Weber, accepted the request made by Minister Alexandre de Moraes for the trial of the next defendant of 8/1 to be in the virtual plenary, where ministers just cast their votes in the system. Voting will take place from September 26th until 11:59 pm on October 2nd, 2023.

Moacir José dos Santos, 52 years old, will be the fourth defendant tried by the Supreme Court due to the acts of January 8th. Moacir was arrested inside the Palácio do Planalto, but was allowed to await trial in freedom.

Initially, it was expected that Moacir would be tried together with the other three defendants last week. As this was not possible, the trial had to be scheduled again.

In his statement, Moacir said that he considers himself a “victim of the State”. The accused said that he went from Cascavel (PR), where he lives, to Brasília in a chartered bus with 60 other people.

Moacir also said that he did not pay for the trip and that he participated in a peaceful march to Praça dos Três Poderes. The defendant also said that he entered the Palácio do Planalto after noticing other protesters inside, but denied having participated in any depredation.

According to Moacir’s defense, the complaint from the Attorney General’s Office (PGR) is based on 5 folders that disclosed the acts of January 8th and that it is not possible, from this material, to identify the people who participated in the demonstrations. .

Moacir will be tried for armed criminal association, violent abolition of the Democratic Rule of Law, coup d’état, qualified damage through violence and serious threat to the Union’s assets and deterioration of listed assets.

In previous trials, defendants Aécio Lúcio Costa Pereira and Matheus Lima de Carvalho Lázaro were sentenced to 17 years in prison each. Thiago de Assis Mathar was sentenced to 14 years in prison.
