Rapporteur sends decision on Bolsonaro’s ineligibility to TCU

The Minister of the Superior Electoral Court (TSE) Benedito Gonçalves determined, this Tuesday (4), that the decision that condemned former President Jair Bolsonaro (PL) to ineligibility for eight years be sent to the Federal Audit Court (TCU). ).

Last week, the submission was approved by the majority of ministers who followed Gonçalves’ vote against Bolsonaro. The trial score was 5 votes to 2.

With the conviction sent, the TCU will be able to determine the calculation of expenses to reimburse the public coffers for holding the meeting that Bolsonaro held with ambassadors, in July last year, at the Palácio da Alvorada, reported Agência Brasil.

According to the TSE, the former president committed abuse of political power and misuse of the media by using the Alvorada structure to hold the meeting and TV Brasil, public broadcaster of Empresa Brasil de Comunicação (EBC), to broadcast the event.

According to TSE Precedent 69, the term count begins on the date of the first round of the 2022 elections, held on October 2. The ineligibility will end on October 2, 2030, four days before the first round, scheduled for October 6.

However, the former president may also be ineligible by the TCU. The period of ineligibility for the Court of Accounts starts from the final decision, that is, at the end of the reimbursement process, extending the end of the eight-year ineligibility period to after the 2030 election.

After trial at the TSE, Bolsonaro’s defense stated that it will wait for the publication of the judgment, a document that gathers the votes cast by all ministers, to file an appeal with the Federal Supreme Court (STF).
