The Public Ministry of Amapá (MP-AP) presented a reply to the objection to request the Court of the Single Court of the District of Pedra Branca do Amapari to extend the removal of Elson Belo Lobato from the position of mayor of Serra do Navio, from which he is already removed by court decision. The request is signed by substitute prosecutor Lucas Gomes Leal, and also affects the then secretary of the treasury, Gabriela Souza Machado Bispo. This Friday, the 2nd, Elson Belo suffered the third revocation of his mandate at Serra do Navio City Council.
Among the accusations against Elson Belo, the target of action for administrative improbity, is that of collusion between him and the then secretary Gabriela Bispo, promoting payments without a legal basis, with consequent damage to Serra do Navio’s treasury. These payments totaled more than R$100,000.
“Elson Lobato’s individual conduct was to authorize, order and effectively pay, using his access key and password for payments, amounts to his finance secretary without any payment process and without any legal basis, diverting public resources from the municipality of Serra do Navio. Gabriela Souza’s conduct, in turn, was also to make the payment using her personal access key and password, in addition to being the direct beneficiary of the undue resources. The documentation that proves the veracity of the facts and the fraud are the statements with doubled and even tripled monthly payments”, says an excerpt from the MP’s action.
Furthermore, Elson Belo Lobato is a defendant in a public civil action, which seeks reimbursement from the Serra do Navio treasury of around R$200,000, misappropriated due to the fact that the municipal manager handed over his access key and payment password to third parties, in addition to making payment requests via WhatsApp to their secretaries, ignoring the formalities and legal requirements of the public expenditure stages, causing damage to the treasury. He is also responsible for another public civil action in which the Public Ministry of Amapá seeks the reimbursement of R$ 174 thousand to the Serra do Navio treasury, which resulted from the violation of an agreement signed with Banco Bradesco for the transfer of installments of the loan. of public servants, as well as disobedience to a court order, which led to the municipality receiving a fine of R$50,000. “Therefore, there is no doubt that the extension of the period for the defendant’s removal from the position of mayor is the necessary measure, as the reasons remain duly demonstrated in the records, and with this precautionary measure it will prevent new offenses from happening, given that the Elson Belo’s management is permeated by very serious irregularities that are being investigated in several actions of administrative improbity in this Court”says prosecutor Lucas Gomes Leal, for whom the extension of the leave aims to guarantee administrative public order (avoid the imminent commission of new illicit acts), needing to combat these acts of improbity, protecting the treasury and administrative morality.
