Prerogatives supports Zanin’s nomination and refutes ethical conflict – 06/02/2023 – Panel

The legal group Prerogativas released a note in which it supports the appointment of lawyer Cristiano Zanin for a vacancy in the STF (Federal Supreme Court).

“Cristiano Zanin Martins’ notable legal knowledge was put to the test in complex and highly demanding court debates, in which the lawyer demonstrated not only his brilliant technical proficiency and mastery, but also a personality of unusual temper, as well as an inflexible commitment to principles and values ​​of a constitutional nature”, states the group.

Formed by lawyers and legal professionals aligned with the Luiz Inácio Lula da Silva government, Prerrogativas had other preferences in the race for the vacancy opened by the retirement of Ricardo Lewandowski, such as professors Pedro Serrano and Lênio Streck. Part of the group also favored Manoel Carlos de Almeida, former secretary general of the STF.

Despite this, the group never had anything against Zanin, according to its coordinator, lawyer Marco Aurélio de Carvalho.

In the note, the group also refutes the argument that there would be an ethical impediment due to the fact that the nominee was Lula’s lawyer in Lava Jato.

“By becoming a magistrate, the lawyer leaves the condition of representative of his clients and terminates his contractual ties. It will only be up to declare suspicion or impediment in the examination of causes that he has sponsored or in relation to which he has issued a specific opinion”, says the Prerogatives.

In addition, says the group, the guarantee of lifetime gives the minister independence from the authority that appointed him.
