The Chamber of Deputies approved, this Wednesday (20), the bill that restricts the temporary release of prisoners on commemorative dates, known as PL das “saidinhas”. The text goes on for sanction by the President of the Republic, Luiz Inácio Lula da Silva (PT).

The president of the Chamber, Arthur Lira (PP-AL), informed that the proposal was approved in a symbolic vote, unanimously, in the House. The only party that entered into obstruction was PSOL, which had divergent positions among its members.

The “saidinhas” bill returned to the Chamber, after being approved by the Senate on February 20th with some changes.

According to the approved text, the benefit will be granted to inmates in a semi-open regime only if they are to attend supplementary vocational training, secondary education or higher education.

Currently, the Penal Execution Law (Law 7,210/84) also allows temporary departure for up to seven days four times during the year to visit family or participate in activities that help return to social life.

If you are going to take a vocational supplementary course, high school or higher education, the period will be as long as necessary to complete school activities.

The vote gained more strength after the escape of two inmates from the federal prison in Mossoró (RN).

The urgency surrounding the debate was also pressed by governors and was revived in early January, when Minas Gerais Military Police sergeant Roger Dias da Cunha, aged 29, was shot in the head and killed during a chase in Belo Horizonte. The gunman is an inmate who had not returned to the penitentiary after his temporary release from Natal – he has a long criminal record with 18 stints with the police. The case generated national commotion.

Right-wing deputies celebrated the approval

Deputies from the conservative bench and public security celebrated the approval of the proposal.

“The end of the benefit aims to guarantee the safety of society and the integrity of the victims. It is absolutely unacceptable that individuals who should be serving sentences in prison benefit from temporary releases and then commit new crimes. This practice compromises the safety of the population “, celebrated deputy Sergeant Portugal (Podemos-RJ).

For deputy Coronel Assis (União-MT), the so-called sadinha is a “legal excretion” because it was distorted. He said that, in other countries, there is a similar legal figure, but freedom is conditioned on several factors to be observed.

Representative Nikolas Ferreira (PL-MG) and other parliamentarians recalled the murder in January of a sergeant from Minas Gerais by a prisoner who was on temporary release. “Unfortunately, his life was taken because of a right, in fact, a privilege, of a criminal who was under the control,” said Ferreira.

Contrary to the project, deputy Pastor Henrique Vieira (Psol-RJ) stated that the end of the temporary exit will penalize 95% of people who comply with the measure because of less than 1% who do not comply. “We cannot think about public policy and legislation based on exceptions, denying concrete data. The debate is being carried out in a sensationalist way, which does not solve the problem of public security”, said the deputy.
