Petrobras will pay a billionaire figure if Carf passes the Senate – 07/16/2023 – Mônica Bergamo

Petrobras will account for more than half of the collection of approximately R$50 billion that the Lula government hopes to achieve with the approval of changes in the judgments of Carf, the Tax Appeals Administration Council. The body judges cases of dispute between the Tax Authorities and taxpayers.

A government project that is under analysis in the Senate ends the format implemented in the government of Jair Bolsonaro (PL), which defined that, in the event of a tie in the judgment, the company accused of owing taxes would benefit. In the new rules foreseen, the score would be tied by a representative of the National Treasury, that is, of the State.

Petrobras, according to information from the Ministry of Finance, has outstanding amounts of approximately R$ 147 billion. Of the total, around BRL 30 billion can no longer be appealed and, with the new tiebreaker system, would have to be paid next year.

The resources from the Carf disputes estimated by the government are equivalent to an important portion of the revenues that the government needs to realize in 2024, to reach the promised zero deficit in public accounts.

According to a National Treasury report, the government needs additional revenue of R$162.4 billion to close accounts next year.

Senator Otto Alencar (PSD-BA), chosen to report on the proposal, has already stated that he will deliver his opinion in mid-August.
