Party cannot oblige members to contribute, decides TSE

The ministers of the Superior Electoral Court (TSE) reinforced in a session, this Thursday (15), that parties cannot impose an obligation to contribute to affiliates. The decision refers to the application submitted by the Citizenship party for changes in the statute of the caption. The rapporteur for the case was Minister Raul Araújo.
According to the Electoral Court, the rules approved by the party – referring to the mandatory contribution of affiliates and the application of sanctions in case of non-payment – are contrary to the understanding of the TSE. The ministers also considered the restriction of the participation of non-paying affiliates in conventions for choosing candidates to be unacceptable.
Only the changes defined by the party at the March 2022 national meeting were approved, such as the new wording for principles and objectives, rules for party affiliation and withdrawal, rights and duties of affiliates.
