Opposition files request to open CPI on Abuse of Authority

After obtaining the signature of 171 federal deputies, the opposition bench in the Chamber of Deputies filed this Wednesday (29) the request to open the CPI on Abuse of Authority to investigate the “abuses” committed by the Federal Supreme Court (STF) and the Superior Electoral Court (TSE).

Representative Marcel van Hattem (Novo-RS), author of the CPI, announced the CPI protocol on Wednesday night (29). At the beginning, he recalled the death of Cleriston Pereira, the 8th of January defendant who died last Monday, in Papuda, in Brasília, and attributed the fatality to an error by the STF.

“Unfortunately, even one death had to occur so that the seriousness of the situation could generate the appropriate scenario for the installation of the CPI. Now, we will work to investigate the facts”, adds van Hattem.

For the deputy from Rio Grande do Sul, investigations are urgent to determine the recent measures taken by the Judiciary. “Unfortunately, it has been common to see ministers from the TSE and STF exceeding their competences and taking decisions that belong to the Legislative and Executive branches. This abuse of authority needs to stop and that is why we are proposing the CPI”, highlighted van Hattem .

The parliamentarian also highlighted that many other deputies stopped signing the request out of “fear or fear” because they were being or were beginning to be investigated by the STF.

Opposition leader Carlos Jordy (PL-RJ) highlighted the difficulty in obtaining signatures. “The reason it is difficult to collect these signatures is the reason why many did not sign because they were afraid of the Supreme Court’s arbitrariness,” he said.

After the request is filed, it needs to be read by the President of the Chamber, Arthur Lira (PP-AL) for the CPI to be installed in the house.

As there is less than 1 month left until the parliamentary recess, the installation of the CPI should be postponed until next year. Unlike last year, when the request was archived, due to the change of legislature.

“We will talk to Arthur Lira so that it can be installed as soon as possible”, highlighted van Hattem.

Arbitrariness

In announcing the signatures of the CPI, parliamentarians pointed out a series of arbitrary acts that have been committed by Supreme Court ministers.

Senator Jorge Seif (PL-RJ) cited the fact that STF ministers ignored requests from the Attorney General’s Office (PGR), disrespect for lawyers’ prerogatives and interference in votes such as PEC 8/21, which limits decisions monocracies of ministers.

“PGR, today, is ignored. Lawyers do not have access to their clients’ files, in addition to so many monocratic decisions. And it was shameful to see on the day of voting on PEC 8, ministers calling senators threatening them if they voted in favor of the proposal,” Seif told People’s Gazette.
