The Senate’s CCJ (Constitution and Justice Committee) approved this Wednesday (29) the PEC (proposed amendment to the Constitution) that prevents active military personnel from the Armed Forces from running. The proposal must still be analyzed by the Senate plenary and, if approved, by the Chamber of Deputies.

The vote took place in around 40 seconds, after the hearing of ten authorities appointed to the CNMP (National Council of the Public Ministry) and the CNJ (National Council of Justice).

Sponsored by the Lula government (PT), the PEC was presented in September by the government leader in the Senate, Jaques Wagner (PT-BA), to “guarantee the political neutrality of the Armed Forces”. The text received a favorable opinion from Senator Kajuru (PSB-GO), one of the government’s deputy leaders.

In his report, Kajuru states that “active members of the Armed Forces should not be linked to political-partisan activities, which is why the original constituent restricted their participation, while on active service, in the political-electoral process.”

“Federal military personnel who wish to apply, if they already have more than 35 years of service, will not suffer significant limitations, since, even when transferred to the reserve, they will maintain their income normally, without this affecting their lifestyle”, says an excerpt of the opinion.

“As for those who have not yet served 35 years in the barracks, although the decision to apply will result in a transfer to the unpaid reserve, if they are elected, they will have another source of remuneration during their term of office and, if they are not, they will not lose their rank , if they are officers.”
