Nunes Marques suspends Minas Gerais PM contest due to restrictions on women

The Minister of the Federal Supreme Court (STF) Nunes Marques suspended this Thursday (29) the public competition for the selection of soldiers for the Military Police of Minas Gerais. The test, which was scheduled for March 10, limited women’s competition to 10% of the 2,901 places offered. According to the Court, the suspension is valid until the merits of the case are judged or until the publication of a new notice that guarantees candidates the right to compete for all vacancies.

“The prohibition on women competing for all the vacancies available in public competitions intended for occupying positions in a military career contributes to reinforcing the historical exclusion of this group in professional and educational environments, in direct disregard of the constitutional postulates that prohibit discrimination and determine the protection of the female labor market”, highlighted Nunes Marques.

The action was presented by the Attorney General’s Office (PGR). In October last year, the PGR sued the STF against 17 states that apply laws to limit female participation in competitions for PM and Firefighters. The body argued that there is no constitutional support for setting percentages for women to access public positions.

In this Thursday’s decision, the rapporteur also suspended the effects of provisions of state Laws 22,415/2016 and 21,976/2016 that restricted by up to 10% the number of women in the ranks of officers and enlisted personnel of the Military Police and Military Fire Brigade of Minas Gerais. The injunction must be analyzed by the other ministers in the Court’s plenary session.

“It is also important to clarify that such a guarantee to the candidates does not interfere in the competition, nor does it take away any right from men, and it is up to the competition, through the relevant constitutional and legal rules, to make the appropriate selection of the most suitable, regardless of sex”, he wrote. the minister.
