The Minister of the Federal Supreme Court (STF) Nunes Marques asked for a review this Thursday (27) and suspended the judgment on the use of the reference rate, the TR, as an instrument for correcting the accounts of the Fundo de Garantia por Tempo de Serviço (FGTS) . The magistrate would be the third to vote. Last week, Minister Luís Roberto Barroso, the case’s rapporteur, defended the change in the correction so that the FGTS income is not lower than that of savings. However, the change in income must not be retroactive. The understanding of the rapporteur was followed by Minister André Mendonça.

According to the Court’s regiment, Nunes Marques has up to 90 days to analyze and return the matter for trial. He argued that he received, like the other ministers, a “vast material” presented by the Attorney General’s Office (AGU) on the subject, but hopes to return the file next week for further analysis. The federal government is against the change in the correction of the FGTS.

“What I bring is a request for review, which should not take long, just to complement this analysis of these arguments… But with the certainty that the request for review does not bring absolutely any harm because the adjustment is not made monthly”, he said.

“That is, voting on this next week or the following week will bring absolutely no harm to the holders of land deposits, since the thesis brought by the eminent rapporteur is a sacred winner, this adjustment will only be made in the middle of 2024”, completed Nunes Marques.
