The National Council for Human Rights (CNDH) prepared a note in which it asks that the budget of the Federal Public Defender’s Office (DPU) not be affected by the restrictions of the fiscal framework, which was proposed by the Lula government to balance public accounts and must be voted on in the House on the 15th.

The collegiate body, which is linked to the federal administration, claims that the current spending ceiling has already affected human rights policies, and that access to justice can only be effectively guaranteed if the budget limit imposed on institutions of justice is relaxed. defense and promotion of rights.

“If the restrictions on the Public Defender’s Office are maintained and eventually applied, compliance with the Constitution regarding the expansion of access to Justice through the Public Defender’s Office will remain paralyzed, perhaps unfeasible, since, at the federal level, new units of the Public Defender’s Office cannot be installed. DPU, nor appointed new public defenders or public servants”, says the document.

The CNDH points out that 71% of the national territory still does not have the service provided by the Public Defender of the Union, and that the approximately 680 federal public defenders in activity form an “absolutely insufficient” number to expand the body’s reach to all jurisdictional units. federal.

The note also states that the current budget of just over BRL 700 million for the DPU is lower than that guaranteed to the other bodies of the justice system, such as the Advocacy-General of the Union, which has about BRL 4 billion, and the Public Ministry of the Union, with R$ 8 billion.

Even the minimum increase provided for by the new fiscal framework would not guarantee equality of conditions and parity of arms between the bodies, maintains the council. “The construction of the new fiscal anchor […] cannot ignore the harmful effects of the current spending ceiling on human rights policies, such as the example of the disproportionate impact on the Federal Public Defender’s Office”, states the CNDH.

The collegiate body still defends the construction of a joint solution, with the participation of the DPU and entities that represent vulnerable people, to correct, through the fiscal framework, what it calls a “historic error” committed by the spending ceiling.
