Former Lava Jato judge and former Minister of Justice, Senator Sergio Moro (União-PR) blames the government of President Lula (PT) for the decision of the TSE (Superior Electoral Court) that annulled the mandate of Deputy Deltan Dallagnol (We can -PR). For Moro, the court ministers misinterpreted the Clean Record Law. In addition to disagreeing with the decision, he criticized the attitude of Lula’s allies.

“There is no reason to celebrate. The government has insisted on polarization as a political strategy, which is the same strategy that was criticized in the previous government. country that is for everyone and we will respect political differences?”, he questioned.

Despite the TSE’s decision against Deltan, the former minister declared that he was calm about his mandate and recalled that, at the end of last year, the court unanimously upheld the validity of his candidacy.

What is your assessment of the TSE’s decision? I regret the decision. I respectfully dissent from her. It is a shame. I think Brazil loses and politics loses, but I hope that the TSE or STF can eventually review the decision.

Deep down, I blame the government, because the PT and the government have been building this climate in Brazil of continued polarization. So, the court applied the law, I think it misinterpreted the law, not the best. But, deep down, it is this context of impeachment, threat, censorship, that is not good for the country.

The action against Deltan was filed by the PT, but the decision was taken by seven judges, three of which were appointed by former President Jair Bolsonaro. I respect the courts, the TSE, the ministers, their understanding and this has to be discussed in the proper appeals. Now, there is a context that we cannot ignore, which is a context of persecution of the opposition. In any government, there are people who support the government and there are opposition. We have to discuss projects, but the big problem is that the government and Lula, in particular, have been contributing with discourse that does not pacify the country.

Do you believe that the PT and government allies articulated in favor of this decision to revoke Deltan? I can’t comment on facts I don’t know. I saw the decision. And this climate provoked by the Lula government, which favors the persecution of the opposition, makes it difficult for a decision like this, which is controversial, to be well received.

Deltan said that the corrupt are partying with the decision of the TSE, including Minister Gilmar Mendes, of the STF, and deputy Aécio Neves (PSDB). Do you agree with this statement? What I saw were manifestations of political agents, of people celebrating the impeachment of the mandate. I did not see any position taken by Minister Gilmar Mendes in this regard. I did see some politicians celebrating. It lacks a little humanity. They may not like the deputy, but the deputy suffered an impeachment of mandate, frustrating 344 thousand voters there. There’s no reason to celebrate.

Any parliamentarian who is subject tomorrow to a process in the Council, if he resigns before, is he ineligible? So I don’t think it’s the best interpretation.

Do you think there will be pressure or a need to change the Clean Record Law? I don’t think it’s the case to review the Clean Record Law. What exists was an interpretation in a specific case. I think it’s too premature to talk about it. [revisão da lei].

Adversaries and critics say Mr. also contributed to this climate of polarization. No way do I see it that way. Whoever was prosecuted in Lava Jato received a bribe or paid the bribe. These are decisions that were upheld by the appellate courts of the 4th region, were upheld by the STJ [Superior Tribunal de Justiça]. What followed was a review, a revenge against this fight against corruption that I regret, but I never dealt with these issues from a personal point of view.

I never made any manifestation of mine celebrating, for example, someone’s misfortune at the time of Lava Jato. What existed there, say what you will, was law enforcement. The big problem is that this is not a topic of the day. In my speeches in the Senate, I didn’t mention the triplex, I didn’t mention the small farm in Atibaia. We are focused on the present and the future. This has to be the government’s focus, not the revisionism of the past.

Mr. Do you feel, in any way, threatened by this understanding of the TSE in the face of actions that are filed against your election? I’m very calm. The law and the facts are in my favor. There are two actions in the TRE [Tribunal Regional Eleitoral] of Paraná, in my view, absolutely unfounded [tratam de acusação de caixa 2 e de abuso de poder econômico]. And the TSE, in December of last year, by unanimous decision, maintained my candidacy.

Do you believe that any nomination of Cristiano Zanin to the Supreme Court would be approved by the Senate? What would his posture be? I will only manifest when the indication comes. What I can only say is that whoever is nominated, the Senate needs to fulfill its role of conducting a rigorous hearing, with no personal issues involved. Really discuss whether the nominee meets the constitutional requirements, which are notorious legal knowledge and unblemished reputation. And thinking about the STF institutionally, what we want from a Federal Supreme Court. We want an independent STF.

What is your assessment of the current management of the Ministry of Justice, the portfolio that Mr. already headed? the minister himself [Flávio] Dino is a qualified person, a federal judge, he also left his career, then he was governor. He is even a personable person, but it’s time for us to put the ball on the ground and discuss public policies naturally. This climate of polarization ends up harming this debate itself.

How is the process of threats against Mr. that was dismantled by the PF? The group in charge of carrying out those acts is responding in court, including preventive arrests of the two main perpetrators because they are leaders of organized crime involved in the planning of a murder. It seems to me that the Federal Police has done a great job. Here in the Senate, we presented a project, which was approved, which fills an important legal gap: criminalizing the planning of organized crime attacks on public authorities.

Mr. talks a lot about making public debate healthier and, for that, one step is to recognize when opponents are right. Do you see any successes of the current government in these first months of government? The maintenance of this climate of polarization has, deep down, generated damage to a correct and unbiased assessment of the facts and many times these public policies have been obscured by mistakes. We see, for example, the attempt to revoke the new Sanitation Legal Framework. This creates tension with Congress, this creates tension with society and the government’s positive actions end up being obscured by these actions, which are much louder.

If the vote on the fiscal framework in the Senate was today, Mr. Would you vote for or against? Today I would probably vote against it. I particularly disagree with the way it was done. I think he’s loose. Deep down, it is a project that generates fiscal expansionism, when the correct measure, in my opinion, is to cut expenses and thus we manage to enter a line of decline in interest rates to activate the economy and people to grow mainly through private investment.
