Defense of Cid, Bolsonaro’s former assistant, asks the STF to revoke his arrest – 05/19/2023 – Politics

The defense of Lieutenant Colonel Mauro Cid asked the STF (Supreme Federal Court) to revoke the preventive detention, decreed by Minister Alexandre de Moraes in the context of an investigation that investigates fraud in the vaccination card of Jair Bolsonaro (PL).

A former assistant to the former president, the Army officer also asked for the case to be referred to the PGR (Attorney General of the Republic), a body that had previously manifested itself only for the temporary arrest of him and others investigated by the Federal Police.

Cid was at PF headquarters this Thursday (8) to give testimony, but claimed the right to silence and did not respond to questions from federal agents.

Cid’s defense, who has been in jail since May 3, argues that other alternative measures to prison can be applied to the case.

“The nighttime home confinement, the prohibition of contact with the other investigated persons, the prohibition of leaving the country and the delivery of your passport are fully sufficient to safeguard public order and economic order”, says the military’s defense.

Finally, the defense also stressed, there is no risk of non-compliance with precautionary measures, “unless we consider that the Brazilian Army could be colluding with the non-compliance with a STF order, which, obviously, would cause a complete institutional rupture, something completely inconceivable in the democratic rule of law of the Republic of Brazil”.

He also cites existing precedents in the Supreme Court, from the rapporteurs of ministers such as Luiz Fux, Roberto Barroso and Gilmar Mendes.

“In the same vein, in a recent judgment of the 2nd Panel of this Supreme Court, in a vote by the rapporteur of Minister Gilmar Mendes, it was established that ‘the consolidation of an accusatory system is a fundamental element of criminal procedural dogmatics, with the separation of the functions of investigating, accuse and judge. This is an indispensable measure for the effectiveness of the impartiality of the Judiciary.”
