Moraes votes for the conviction of five more 8/1 defendants

This Tuesday (26), the minister of the Federal Supreme Court (STF), Alexandre de Moraes, voted to convict five more defendants accused of the acts carried out on January 8.

The sentences imposed by the minister repeat the understanding established in the first trials and range from 12 to 17 years in prison.

Moraes voted to sentence João Lucas Vale Giffoni, Jupira da Cruz Rodrigues and Nilma Lacerda Alves to 14 years in prison. The defendant Davis Baek was sentenced to 12 years, and Moacir Jose Dos Santos, to 17 years.

All five were charged by the Attorney General’s Office (PGR) with the crimes of armed criminal association, violent abolition of the Democratic Rule of Law, coup d’état and qualified damage.

It is the first vote since the actions began to be judged in the virtual plenary, when ministers simply cast their votes in the Court system without discussion.

Also this Tuesday (26), Moraes should have a meeting with representatives of the Brazilian Bar Association (OAB) to discuss the prerogatives of the lawyers of the 8/1 defendants and the defendants’ right to defense.

The main agenda of the meeting is a request for reconsideration to the minister so that the trials of the next defendants take place in person, with the oral support of the votes of the ministers and lawyers, and not in the virtual plenary.

The meeting will take place almost a week after Moraes denied a request from the OAB for the trials to return to the physical plenary.

The decision to send the actions to the virtual plenary was taken by the President of the Court, Minister Rosa Weber, in response to a request from Moraes.
