Brasilia DF) – Minister Alexandre de Moraes, of the Federal Supreme Court (STF), maintained the arrest of 140 people detained for involvement in acts of terrorism and the destruction of public buildings in Brasília (DF).
In the decision, on Tuesday (17), Moraes highlighted that arrests in flagrante delicto were converted into preventive ones due to “illicit and very serious conduct, with the aim of, through violence and serious threat, coercing and preventing the exercise of constitutional powers constituted”.
Pre-trial detainees are liable for the crimes set forth in articles 2, 3, 5 and 6 (terrorist acts, including preparatory acts) of Law 13,260/2016, and in articles of the Penal Code: 288 (criminal association); 359-L (violent abolition of the democratic rule of law); 359-M (coup d’état); 147 (threat); 147-A, item 1, paragraph III (persecution); and 286 (incitement to crime).
According to the STF, another 60 people obtained provisional release with the application of precautionary measures. According to the minister, although there are strong indications of authorship and materiality in the participation of people released in the crimes investigated, there is no evidence of the practice of violence, invasion of buildings and depredation of public property.
Among the precautionary measures that released prisoners must follow are the use of electronic ankle bracelets and appearing in court every Monday. They will also have their passports canceled and are banned from using social media.
Analysis of the arrests of other prisoners
According to the STF, 1,459 custody hearings were held for prisoners after anti-democratic acts in Brasília. All cases will be analyzed by the STF, which is responsible for deciding who remains in prison and who eventually can respond in freedom.
The forecast is that the conclusion of the analysis of all cases will take place by Friday (20).
Since President Luiz Inácio Lula da Silva was elected in the second round, at the end of October, supporters of former President Jair Bolsonaro have demonstrated their dissatisfaction with the result of the election and have called for a military coup in the country to overthrow the democratically elected government.
The demonstrations of the last few months included encampments in several general headquarters in the country and culminated with the invasion and depredation of the headquarters of the Three Powers, in Brasília, on January 8th.
