MBL supports comedian denounced for capacitism – 04/24/2023 – Mônica Bergamo

Movimento Brasil Livre (MBL) is providing legal support to comedian Bruno Lambert, who became the target of a police investigation after making a capacitist joke during a stand-up comedy show. The group decided to join the case after federal deputy Tabata Amaral (PSB-SP) called the São Paulo Public Ministry (MP-SP) against the comedian.

During a performance, Lambert told viewers about an occasion when he allegedly had a sexual relationship with a person who used a wheelchair. The situation was described by the comedian through derogatory expressions.

“Have you ever fucked a wheelchair user? No, neither have I. Do you know why? Because you can’t,” he said, at a certain point in the stand-up. “I put her on all fours here, she wilted. Then you had to pick her up here, put her down… It looks like crossfit, understand?”, he continued.

He even referred to the character in his story as “pie”. An excerpt from the presentation was recorded on video and published by the comedian on his Instagram profile.

Last week, two MBL lawyers obtained, in court, the preliminary suspension (provisional) of an investigation against Bruno Lambert motivated by his lines. The investigation was opened after a request from the Public Ministry of São Paulo.

To the 1st Chamber of Criminal Law of the Court of Justice of São Paulo, the defenders stated that the comedian “began to be persecuted by the media by federal deputy Tabata Amaral” and denied that he had committed any type of discriminatory practice.

“Anyone who performs at a comedy show aims to make people laugh and have fun. Comedy is an artistic expression as old and important as drama,” said lawyers Catalina Soifer and Luiz Felipe da Rocha Azevedo Panelli, hired by MBL .

“What does the patient [Bruno Lambert] intended was to make people laugh through the narrative of a specific situation —an alleged sexual relationship he had with a wheelchair user—, and not to propagate any form of prejudice”, they added.

Judge Ivo de Almeida accepted the request made by the lawyers and suspended the progress of the police investigation against Lambert, which was being processed at the 1st Police Station for Persons with Disabilities, in São Paulo.

“The issue proves to be, indeed, controversial, deserving further analysis, in time and manner, by the learned judging panel”, concluded the magistrate.

In representation accepted by the São Paulo Public Prosecutor’s Office, deputy Tabata Amaral stated that, in addition to capacitism —as discrimination against people with disabilities is called—, the statements made by the comedian denoted “a latent machismo” by the “explicit” and ” facetious” as he described the alleged sexual relationship with a woman.

“It is evidently a matter of discrimination and degrading treatment towards people with disabilities. Just ask the following question: if the woman in the ‘joke’ did not have a motor disability, would the ‘humor’ uttered by the ‘comedian’ be funny? discriminatory content,” said the parliamentarian.

In March of this year, after the repercussions of the case, Bruno Lambert even thanked MBL on his social networks for the support he had been receiving from the group.

“There are many from the MBL defending me because of the injustice that was done to me, I am very grateful for the help and for having created this MBL movement = Bruno Lambert Movement”, he wrote on the networks.
