Marinho presents PEC to invalidate STF decision on press

The leader of the opposition in the Senate, senator Rogério Marinho (PL-RN) filed a Proposed Amendment to the Constitution (PEC), to invalidate the decision of the Federal Supreme Court (STF) that holds newspapers responsible for statements made by interviewees.
On November 29, the Supreme Court ruled that newspapers could be held responsible for “proven insulting” statements made by interviewees against third parties. The ministers defended the thesis when analyzing an action presented by former deputy Ricardo Zarattini Filho, who died in 2017, against the newspaper Diário de Pernambuco. The STF’s decision was criticized by press entities and pointed out by experts as vague, in addition to imposing “self-censorship” on newspapers.
In the proposal, Senator Marinho proposes the inclusion of a paragraph in article 220 of the Federal Constitution, which establishes that the “media outlet does not respond civilly when, without expressing an opinion, it broadcasts an interview in which the interviewee attributes an illicit act to a specific person”.
“Holding a media outlet liable simply because an individual expressed his or her opinions to the press is a measure that, in our view, very clearly restricts press freedom. This freedom is a fundamental pillar of our democracy and must be preserved at all costs”, declared the senator in justifying the proposal.
Until this Thursday (7), 28 signatures were recorded for the PEC. To be approved, 49 senators, out of a total of 81, must vote in favor of the proposal in two rounds. Once approved by the Senate, the text will be analyzed by the Chamber of Deputies.
