Brasilia DF) – In the first 200 days of government, President Luiz Inácio Lula da Silva revoked 97 of the 210 decrees, ordinances, normative instructions and resolutions of the previous government, considered a priority for guaranteeing the rights of the population. The note is from a study carried out by the Lauro Campos and Marielle Franco Foundation and by the regional office in Brazil of the German foundation Rosa Luxemburgo.

The pushing Revocation and the Reconstruction of Brazilian Democracy shows, for example, the revocation of studies for the privatization of state-owned companies and the withdrawal of companies from the privatization program, such as Correios, Empresa Brasil de Comunicação (EBC), Dataprev, Serpro and Conab.

Another point of the study is the reconstruction of the gender policy area of ​​the Unified Health System (SUS), care for the LGBTQIAPN+ population, indigenous peoples and quilombolas. An example is the annulment of Normative Instruction n. 128, of August 30, 2022, which prevented the titling of quilombola lands. The Lula government also recreated the defunct National Council for the Rights of Lesbian, Gay, Bisexual, Transvestite, Transgender, Queer, Intersex, Asexual and Other Persons, revoking Decree 9,883/2019, which created the National Council to Combat Discrimination.

Also in 2022, researchers from the two institutions had analyzed about 20,000 infralegal norms, from decrees, ordinances, normative instructions and resolutions of former president Jair Bolsonaro, in addition to hundreds of provisional measures, bills and constitutional amendments. The work was presented to the transitional government of Lula’s government.

“We identified sensitive and important advances. With this new study, we hope to expand the public debate and strengthen the arguments to continue removing the infralegal obstacles left by Bolsonarism. This way we can advance even further in the winning social rights agenda at the polls”

The 97 acts revoked in 2023 by President Lula are part of a list of priorities listed in 2022. Of this set of annulled norms, 60 were identified as a key issue for democracy in Brazil.

According to political scientist Josué Medeiros, coordinator of the Analysis, Research and Studies Center (NAPE) and of the Revogaço research in 2022 and 2023, other topics such as drug policy should also see progress soon, especially after the conclusion of the vote in the Federal Supreme Court on the decriminalization of marijuana possession.

“With the 2023 survey, we analyze how far we have advanced in 200 days of Lula’s government and we also highlight how much progress remains to be made, which will only happen with the mobilization of Brazilian society in defense of democracy”
