President Lula (PT) said this Tuesday (16) that the Access to Information Law has been “raped” in recent times, in a criticism of former president Jair Bolsonaro (PL), although he did not mention him in his speech. .

Despite demanding transparency from the previous administration, the Lula government has already imposed secrecy this year on the records of visitors to the Palácio da Alvorada, on the grounds that publicizing it could jeopardize their safety and that of their family, on the completeness of the images. acts of vandalism recorded by the Planalto Palace camera system (later revoked by STF Minister Alexandre de Moraes) and also on the guest list for the reception at the Itamaraty after the PT’s inauguration, on January 1 (the measure generated wear and tear, and the list was later released).

Lula’s speech took place during the opening event of the seminar “Transparency and Access to Information: Challenges for a New Decade”, in celebration of the 11th anniversary of the LAI (Access to Information Law).

The president signed three decrees with measures that seek to strengthen transparency and access to public information.

The first act modifies the current decree that regulated the Access to Information Law. Another provides for the creation of the Council for Transparency, Integrity and Combating Corruption. The latter creates the System of Integrity, Transparency and Access to Information and the Policy of Transparency and Access to Information of the Federal Public Administration.

Regarding the decree that regulated the Access to Information Law, the main change will be related to the imposition of 100 years of secrecy. This secrecy is provided for personal information relating to intimacy, private life, honor and image.

The new decree maintains that this information is restricted for this period, regardless of classification of secrecy.

However, the new act determines that this secrecy does not imply the restriction of the entire content of the information. Thus, the government must guarantee access to the rest of the document, only carrying out the concealment, anonymization or pseudonymization of personal information subject to secrecy.
