Brasilia DF) – Minister Ricardo Lewandowski, of the Federal Supreme Court (STF), denied habeas corpus that requested safe conduct from former President Jair Bolsonaro (PL) and former Minister of Justice and Bolsonaro and former Secretary of Public Security of the Federal District, Anderson Torres. Both are investigated for suspected involvement in the coup acts of January 8 in Brasilia.
The request was made by lawyer Carlos Alexandre Klomfahs – the same one who asked for the freedom of prisoners for coup acts in the Superior Military Court (STM). The minister understood that it is not possible to request habeas corpus on behalf of third parties who already have lawyers in investigations that are being processed by the Court. He pointed out that, for this, authorization from Bolsonaro and Torres would be required – which was not included in the case file.
Lewandowski also recalled the understanding of the Supreme Court that does not allow habeas corpus against acts by ministers or collegiate of the STF. The same argument was used yesterday to deny requests for freedom in favor of two prisoners for involvement in the January 8 acts.
