Minister Ricardo Lewandowski, of the Federal Supreme Court (STF), rejected this Wednesday (18) a preventive habeas corpus that requested safe conduct for the former President of the Republic, Jair Bolsonaro, and the former Minister of Justice, Anderson Torres. . The request was presented by the lawyer Carlos Alexandre Klomfahs, who is not part of the defense of investigated.

The lawyer requested that the investigation against the two be suspended “due to the absolute absence of minimal evidence of authorship and materiality, with the effects extending to all those indicted/convicted in the said investigation”. In the petition, Klomfahs also highlighted that Bolsonaro has delicate health and must have his presumption of innocence assured, avoiding a possible “media arrest”.

The request was rejected by Minister Lewandoswki because it was presented by third parties and not by the defense of those investigated. “I deny following the present action, pursuant to art. 21, § 1, of the RISTF, since the filing of habeas corpus on behalf of third parties, who already have lawyers constituted in different investigations that are being processed in this Supreme Court, requires express authorization from the patients, which was not included in the file”, said in the decision.

Last Friday (13), the Attorney General’s Office (PGR) asked the Federal Supreme Court (STF) to include former President Jair Bolsonaro (PL) in the investigation that investigates the “instigation and intellectual authorship of anti-democratic acts ” related to acts of vandalism and violence in Brasília on the 8th. Only Anderson Torres had his arrest ordered by Minister Alexandre de Moraes, while Jair Bolsonaro is still being investigated.
