Former Minister of Justice and now Senator Flávio Dino (PSB-MA) will present this Monday (19) a Proposed Amendment to the Constitution (PEC) that intends to put an end to compulsory retirements for judges, prosecutors and military personnel who commit serious crimes, in addition to exclusion from public service. It will be one of his last proposals before resigning from his position to take office at the Federal Supreme Court (STF).

Dino announced the “agenda” of the week on social media this Sunday (18), in which he explained that he will give a “farewell speech” on Tuesday (20), sign his resignation on Wednesday (21) and take office as minister of the STF on Thursday (22).

“I will present to the Senate, with a view to supporting signatures, a Proposed Amendment to the Constitution (PEC) making it clear, definitively, that judges, prosecutors or military personnel who commit serious crimes must be excluded from public service. And not ‘compulsorily retired’ or benefiting from a ‘fictitious or presumed death pension’”, said Dino.

He further stated that “there is no reason for this inequality of treatment in relation to other public servants who, for example, commit crimes such as corruption or of similar severity”.

To pass the project, Dino needs the support of 27 of the 81 senators. In addition to this proposal, he says he intends to present three other bills, but without mentioning their content.

Since leaving the government, Dino has already presented a bill that intends to prohibit the setting up of camps near barracks, such as those that occurred after the 2022 presidential election and which culminated in the acts of January 8, 2023.

Flávio Dino’s proposal on the end of compulsory retirements, however, contradicts his own opinion in a master’s thesis prepared in 2001. At that time, Dino was opposed to the dismissal of judges by administrative act, highlighting that this would revoke an important guarantee of the independence of the judiciary.

The proposed PEC comes at a time when the senator criticizes actions to restrict the powers of the STF and suggests legislative measures, such as prohibiting people from camping in front of barracks.

Upon assuming the position of minister of the STF, Dino will inherit the rapporteurship of 344 cases that belonged to minister Rosa Weber, who retired last year. Among them are investigations involving the Minister of Communications, Juscelino Filho, on suspicion of embezzlement of public resources and money laundering with Codevasf funds.
