Kassab tries to extinguish actions in the STF – 07/13/2023 – Panel

The former mayor of São Paulo Gilberto Kassab (PSD) asked the STF (Federal Supreme Court) this Wednesday (12) for the extinction of two actions of administrative improbity and the locking up of two police investigations. Currently, Kassab is Secretary of Government during the Tarcísio de Freitas administration (Republicanos-SP).

According to Kassab’s defense, the four cases are based on material delivered by employees of the contractor Odebrecht and which has already been considered “useless” by the STF. The defense refers to the electronic systems called Drousys and MyWebDay, which would have been used by the construction company to register illicit payments.

The spreadsheets with the “parallel accounting” served as evidence for the reports made by 78 executives of the contractor, in the midst of a leniency agreement dubbed at the time “declaration of the end of the world” and signed in 2016.

The invalidation of part of the Odebrecht agreement had its first steps when the defense of President Lula (PT) appealed to the STF to have access to the complete electronic systems of the contractor, at the time when he was still a defendant in the Lava Jato in Paraná.

In June 2021, then Minister Ricardo Lewandowski (now retired) declared the “worthlessness of the evidence obtained from the leniency agreement”, favoring Lula’s defense. Lewandowski’s decision was later confirmed by the 2nd Panel of the STF, in February 2022. Since then, other politicians and also businessmen have already benefited from the same decision and “extension requests” accumulate in the Court.

The two investigations opened to investigate Kassab are being processed by the STF and were initiated based on the award-winning collaboration of former Odebrecht executives. In one of the surveys, they narrate alleged payments of undue advantages in the 2008 and 2014 election campaigns, and also in the creation of the PSD.

In the other survey, there are also reports of alleged payments of undue advantages, between 2008 and 2009, related to works on the Strategic Metropolitan Road System of São Paulo, including the Roberto Marinho Tunnel.

Similar content was the basis for actions of administrative impropriety in the State Court of São Paulo. One of them has been pending since 2017 at the 9th Public Treasury Court. The other is in the 13th Public Treasury Court, since 2020.
