Justice prevents Ibama’s operation against illegal cattle – 07/31/2023 – Panel

Federal Justice prevented Ibama (Brazilian Institute for the Environment and Renewable Natural Resources) from carrying out an seizure in Pará of more than 500 head of cattle, valued at R$ 2 million.

The decision was taken by Judge Rafael Paulo Soares Pinto, appointed to the position by former President Jair Bolsonaro (PL) in June 2021.

At the end of March, Ibama notified a farm in the region of Pacajá (PA) for raising cattle in an area that was embargoed due to illegal deforestation. The agency asked that the animals be handled on the non-embargoed part of the property.

The agency’s agents returned on April 7 and registered 510 animals still there. They decided to apply a fine of R$ 100,000 per day and asked to seize the animals.

Initially, the Federal Court denied authorization for the operation and granted an injunction so that the owner could remain as the faithful guardian of the animals and have more time to handle them.

On July 19, the injunction was overturned and Ibama prepared the operation to seize the 510 head of cattle.

The agency also identified that another property, registered in the same location as the fined farm, had moved more than 2,000 head of cattle to other locations. The institute notified the local authorities of the “risk of illegal movement of the apprehended herd”.

A day later, Judge Pinto again prevented the operation, which was planned to take place the following week.

According to him, the apprehension of cattle by Ibama brings “risk of serious damage or difficult repair” for the owner of the animals.

He also claims that Ibama’s notification of the risk of illegal movement “undeniably caused embarrassment and delays in the removal of animals from the embargoed area”.
