Federal deputy Carla Zambelli (PL-SP) sued journalist Luan Araújo for defamation. It is worth remembering that Luan was chased and held at gunpoint by Zambelli on a street in Jardins, an upscale neighborhood of São Paulo, on Saturday, October 29, 2022, the eve of the second round of the presidential elections.

Judge Fabricio Reali Zia, of the São Paulo Special Criminal Court, requested a preliminary hearing and that Luan Araújo remove the content from the air within 48 hours, which is still posted. The determination took place on Friday (28).

Zia claims there was “excess or abuse of said freedoms” of the journalist.

“Despite the constitutional protection of freedom of the press and expression, it is important to emphasize that the exercise of both is not unlimited and, therefore, all abuse and excess, when verified the intentions of injuring, defaming or slandering, may be punished according to criminal law”

he said.

In the text, Luan also highlights how much the episode left negative marks on his life.

“I, the victim in this case, have had several burdens since that day. My personal life turned upside down, I lost important relationships, I started to collect health problems and I live with panic on a daily basis.

For me, a black man, poor and with huge problems, that day is not over. He makes a point of lasting days and more days until today. In a cruel way. For her, a white woman with connections to powerful people, it was just another space to play the classic arena of a petty, evil extreme right that is a merchant of death.”

The journalist stated that when he receives the subpoena he will remove the article from the site, but so far this has not happened. Luan says that he is also suing the deputy for the gun event, and that she is running in São Paulo.

“It’s possibly their defense strategy to cause more upset in the process. I see it with peace of mind”

he stated.

In a note, the deputy’s office states that: “Regarding the judicial decision of last Friday (the 28th), which determined the removal of a defamatory text by journalist Luan Araújo, the defense of federal deputy Carla Zambelli notes that, for a better understanding of the aforementioned decision, it is necessary to remember that when the facts occurred, the deputy was offended, provoked and cursed, which was forgotten by many. These offenses and defamations have not ceased and this criminal complaint precisely wants to stop this hate speech against her.”.

In the fateful video, posted on social media at the time, Zambelli appears pointing a gun at Luan in the middle of the street. Afterwards, she walks into a bar with a pistol drawn.

From the recording, it is possible to hear the deputy talking to the journalist more than once: “lie down on the floor”. People who were at the scene tried to contain her and one claims “she wants to kill me bro”.
