Justice acquits head of PRF under Bolsonaro of improbity – 12/20/2023 – Power

The Federal Court in Rio de Janeiro acquitted the former director of the Federal Highway Police Silvinei Vasques in an action of administrative improbity in which he was accused of using his position in an electoral campaign.
The Federal Public Ministry had stated that Silvinei, who held the position during the Jair Bolsonaro (PL) government, “participated in official public events, gave interviews in the media, as well as made publications on his social networks, in his capacity as general director of the PRF” with the aim of obtaining political-partisan benefits.
The Prosecutor’s Office even pointed out that the former police chief, in a ceremony, presented the then Minister of Justice Anderson Torres with a Flamengo shirt with the number 22, in allusion to the then president’s party number.
The judge responsible for the action, José Arthur Diniz Borges, however, rejected the accusation, citing, among other points, that the new wording of the Administrative Improbity Law, in force since 2021, establishes that the irregularity described needs to be framed “in a strict manner ” in this legal concept to be punished.
“The fact that publications [de Silvinei] Being complimentary, in itself, does not transform posts made on a particular profile into institutional advertising”, wrote the judge in a ruling on Tuesday (19).
For Diniz Borges, the behavior described does not constitute propaganda “funded with resources from the treasury and within the public administration environment”.
The magistrate also said that he received an honor from the PRF, as did the public prosecutor responsible for the accusation, and that this “does not generate any suspicion or procedural impediment because it was the institution that granted us such an honor.”
Silvinei Vasques has been imprisoned since August, by order of STF (Supreme Federal Court) minister Alexandre de Moraes, in an investigation into alleged PRF interference in the second round of last year’s elections.
