The Minister of the Federal Supreme Court (STF) Cármen Lúcia stated this Tuesday (9) that judicial decisions can be questioned, but not violated. The statement comes after billionaire Elon Musk, owner of X (formerly Twitter), said that he would not comply with Minister Alexandre Moraes’ orders.

Cármen Lúcia, who serves as vice-president of the Superior Electoral Court (TSE), led tonight’s session. Moraes, who is president of the electoral court, was not present. Without citing Musk, the judge highlighted that “all natural or legal entities submit to the country’s law and comply.

The minister stated that the TSE “fulfills an essential constitutional duty to apply, and ensure that the law is applied, so that everyone has the guarantee that the legal system is put to be complied with and is complied with, regardless of origin, race , gender, creed, economic condition”.

“All natural or legal persons submit to the law of the country and comply with court decisions. The judge is given the task of judging and ensuring that his judgments are carried out. Public servants, including judges and all people in the Democratic Rule of Law, are given the duty to comply with the Constitution and the laws of the Republic, and observe judicial decisions”, he highlighted.

In the decision that included Musk in the investigation, Moraes said “it is unacceptable that any of the representatives of providers of social networks and private messaging services, especially the current ex-Twitter ‘X’, are unaware of the criminal instrumentalization that has been carried out by the so-called digital militias.” In a post on the platform, Musk suggested that the minister “should resign or be impeached”.

Cármen Lúcia highlighted that “a judicial decision can be appealed, it can be criticized, it can be questioned, it just cannot be violated”.

“To guarantee the authority of judgments and their compliance, there are judges in Brazil. Without an independent Judiciary, guarantor of the effectiveness of its judgments, there is no guarantee of law. Without the guarantee of the Democratic Rule of Law, there is no security of democracy. Without democracy, there is no freedom and, without freedom, there is no dignity”, stated the vice-president of the TSE. She also said that Moraes is a “great Brazilian and magistrate”.
