Judge who supported Bolsonaro is the subject of a complaint at the CNJ – 02/08/2023 – Frederico Vasconcelos

Judge Marco Aurelio Ferenzini, from the Court of Justice of Minas Gerais, asked the CNJ (National Council of Justice), this Wednesday (8), for the return of former president Gilson Soares Lemes to judicial activities at the TJ-MG.

Lemes campaigned for the re-election of then-president Jair Bolsonaro and has been away from his jurisdictional functions for more than four years, managing the Three Powers in Brasília.

According to the request, Lemes “has the clear purpose of being appointed to the Supreme Court or, at worst, to the Superior Court of Justice.”

The current president of TJ-MG, Judge José Arthur Filho, published an ordinance determining that Lemes return to jurisdiction as of Monday.

In a disciplinary complaint, Ferenzini asks that an Administrative Disciplinary Process be instituted involving Lemes and the current president.

José Arthur authorized the creation of the position of Institutional Legal Superintendent for Lemes, which allowed the former president to make political contacts, on behalf of the court, and personally support Bolsonaro’s reelection.

As this blog recorded, Lemes participated in the electoral event at the Federation of Industries of the State of Minas Gerais that formalized Governor Romeu Zema’s support for Bolsonaro’s reelection.

Lemes and his wife, Aliny Kássia e Silva, campaigned in favor of the former president. Aliny participated in electoral events with the first lady, Michelle Bolsonaro, and former minister Damares Alves.

With Bolsonaro’s defeat, Lemes tries to get closer to the Luiz Inácio Lula da Silva government, following the performance of ministers, presidential assistants and PT parliamentarians on social media.

In the complaint, it is requested that Ordinance 5720/2022, by the presidency of the TJM-G, which created the position of Institutional Legal Superintendent for Lemes, be deconstituted. José Arthur’s ordinance is defined as “an affront to the Full Court, to the internal and constitutional order that regulates the matter”.

The disciplinary complaint calls for the immediate closure of the office, considered “an outgrowth”; “invention strange to the practices of the courts”, to facilitate the circulation of the ex-president in Brasília.

In June 2022, the National Justice Department opened a procedure to investigate possible disciplinary infractions committed by Lemes in the installation of the office. The administrative process was opened in the management of the national corregedora Maria Thereza de Assis Moura. The CNJ should judge the case on the 14th.

The complaint states that “there is no way to justify the daring initiative, as no court in the country has an office to serve as a logistical and administrative support base for judges and civil servants”.

Information was asked about the monthly cost of the office structure, “true consulate”, and the existence of official cars and crowded servers.

The TJ-MG reported that it provided information to the CNJ about the installation of the administrative office. Lemes said that the office would be a strategic point, with the necessary infrastructure, for representatives of the Minas Gerais Judiciary to hold meetings and meetings, in addition to maintaining contacts with the superior courts and the CNJ.

Regarding support for Bolsonaro, the judge, consulted at the time, did not comment.

This Wednesday, an ordinance was published in which the president of the TJ-MG “revokes the provision of the Presidency Ordinance No. 5.720, of August 3, 2022, which “Designates a judge for the role of Institutional Legal Superintendent, within the scope of the Secretariat of Court of Justice of the State of Minas Gerais”.
