Judge denies request for injunction to suspend impeachment of mayor of Ferreira Gomes – News of Brazil

Judge Diogo Haruo da Silva Tanaka, from the Single Court of Ferreira Gomes, rejected an injunction request to suspend the decision of the City Council that revoked the mandate of Mayor João Álvaro Rocha Rodrigues, known as Divino Rocha, in a session held on Thursday night , 14. For the judge, the defense of the dismissed mayor, made by lawyer Vicente Cruz, did not present clear proof of infringement of the rules set out in Decree-Law 201/67 and the Internal Regulations of the Chamber, as well as the constitutional principles of broad defense and contradictory. The judge waived a prior hearing to attempt conciliation as it was not appropriate to the case. The deadline for contesting is 15 days.

In the ordinary annulment action with a request for urgent protection, the defense of the revoked mayor alleged the narration of generic facts by the complainant, making it impossible to exercise broad defense and adversary proceedings; ineptness of the complaint for narrating facts that occurred in the previous term, the lack of election for the positions of president and rapporteur of the processing committee; non-compliance with the principle of party proportionality and restriction of defense due to the processing committee not hearing witnesses listed in a timely manner in the mayor’s prior defense.

At least 12 irregularities committed by João Álvaro Rocha, as mayor, were listed, including fraud in the car rental tender, appointment of Laisa Lanoa, investigated in a Federal Police operation in Operation Octopus, to the position of deputy attorney, a position not approved by the chamber; presence of ghost employees on the city hall staff; lack of investigation into acts committed by public servants in Operation Octopus, overpricing in bus rentals (which would belong to the mayor’s brother); non-compliance with the application plan for resources arising from the privatization of Caesa; construction of a village of apartments for his family, through the construction company that provided services to the city hall; fraud in fuel bidding and extrapolation of city hall spending on personnel in 2022 and 2023.

Most of the infractions committed by the impeached mayor, pointed out by the complainant, refer to the current mandate, which took place from 2020 to 2022. With the impeachment of João Álvaro Rocha, vice-mayor Diana Moreira took office in the morning on Friday the 15th.
