The Amapá Court, through the 1st Criminal Court of Macapá, acquitted the journalist Luiz Melo accusation attributed to him by the federal deputy Sílvia Waiãpi, as a transgressor of articles 138, 139 and 140 of the Brazilian Penal Code.
The parliamentarian’s accusation was in reaction to the publication in Daily Communication System and on social media, signed by the journalist, regarding the comments and news reports, at a national level, of what was then considered her participation in the undemocratic acts of January 8, 2023.
In the course of comments and press reports, and also investigations into the attack on the country’s three powers, it was proven that the federal deputy, elected by the state of Amapá, was not in Brasília on January 8th of last year.
The articles of the Penal Code invoked by Sílvia Waiãpi, to condemn Luiz Melo, deals with the crimes of slander (138), defamation (139) and insult (140). The journalist was defended in the process by the lawyer Helder Carneiro. Sylvia described in the complaint that the journalist’s comments and news “they tried to corrupt the public image” her.
In the decision, the Court, upon dismissing the deputy’s request as unfounded, Sílvia Waiãpi, he expressed it this way: “By carefully analyzing the factual presentation, the evidence gathered in the case file, as well as the defendant’s testimony, it is essential to recognize that the crime of slander, defamation or insult has not been established.”
