President of INRua (National Institute of Human Rights for the Homeless Population), Leonildo José Monteiro Filho said that he is concerned about the law that provides for involuntary hospitalization for homeless people with chemical dependency or mental disorders in the city of Florianópolis (SC) , sanctioned on March 1st by Mayor Topázio Neto (PSD).

“The goal [da lei] is to remove people from city centers”, criticizes Monteiro Filho. “It is a hygienist practice, to achieve what they always wanted: to remove the homeless population from the center. We are against this law, which violates human rights in an unconstitutional way”, he says.

Internment, according to the law, can take place with or without the person’s consent. If there is no approval, it may occur at the request of a family member or legal guardian — and, in their absence, a public servant in the area of ​​health, social assistance or public bodies that are part of Sisnad, linked to public policies on drugs.

According to the law, patients will be welcomed by a multidisciplinary team and treatment must address “psychosocial, physical, nutritional, integrative and intellectual aspects”.
