Retirees and pensioners who won a benefit grant or review action against the INSS (National Social Security Institute) in court may be entitled to receive R$2.1 billion in arrears this month.

The amount was released by the CJF (Federal Justice Council) this Thursday (21) and will settle processes that have fully reached their end and had the payment order issued by the judge in February.

In total, R$2.5 billion will be paid to 208,800 beneficiaries who won 167,300 lawsuits against the federal government. Of the total, 2.1 billion refer to social security issues, benefiting 130.4 thousand policyholders who won 99,709 cases.

Citizens who have been granted assistance benefits, such as BPC (Continuous Payment Benefit), are also entitled to the amount.

The batch released this month is almost double that of January, when R$1.2 billion in RPVs (Small Value Requests) were paid. RPVs are delayed by up to 60 minimum wages, which amounts to R$84,720 this year.

The money is released to policyholders by the TRF (Federal Regional Court) responsible for the case. The amount falls into accounts opened at Banco do Brasil or Caixa Econômica Federal. The withdrawal can be made by the insured or his lawyer.

To receive it, the RPV must have been released on a date in February. Payment is made after a stage called processing, which involves opening bank accounts. To find out if you are entitled, you need to consult the TRF website responsible for the action.

RPVs of up to 60 minimum wages are paid within two months after the due date of the action. In the case of court orders, which are processes above 60 minimum wages, payment is made only once a year.

In 2024, the government has already released the annual installment and paid off outstanding court orders, which were held back during the administration of President Jair Bolsonaro (PL).

HOW ARE PRECATORY AND RPVS PAYMENTS MADE?

The money is released by the government to the CJF, according to the request made by the Federal Court body. Afterwards, the council sends the amounts to the TRF responsible for the process in the region where the insured person took legal action against the INSS. To find out whether they will receive it, retirees must consult the TRF website in their region.

As soon as the money is released, a phase called processing takes place, which involves opening accounts at Caixa Econômica and Banco do Brasil, and is usually completed within a few days. When this occurs, the information is placed in the system and the insured has access to it when consulting the website.

HOW DO I KNOW IF IT’S AN RPV OR A PRECATORY?

When searching on the website of the responsible TRF, the acronym RPV will appear, for a small value request, or PRC, for precatório. In general, the insured already knows whether they will receive RPV or precatório before the end of the process, because the calculations are presented beforehand.

HOW DO I KNOW THE DATE ON WHICH I WILL RECEIVE THE DELAYED PAYMENTS?

The date of payment of court orders or RPVs depends on when the judge ordered the INSS to pay off the debt and when the action came to a complete end. Court orders released by April 2nd of one year are paid the following year. RPVs are paid within two months of the judge’s payment order.

This month’s RPVs were fined in January, had the money released in February and should be in policyholders’ accounts by March. The release consultation is carried out on the TRF website responsible for the case.

In São Paulo and Mato Grosso do Sul, the responsible TRF is that of the 3rd Region, and the website for consultation is trf3.jus.br. The insured must inform his CPF or OAB of the lawyer in the case or the case number. See the step by step:
